By accessing or using RailSpotter at railspotter.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Use of the Service

RailSpotter provides a platform for railway enthusiasts to log locomotive sightings, earn points, and connect with the community. You agree to use the service only for lawful purposes and in accordance with these Terms.

You must not:

• Submit false, misleading, or fraudulent sightings or data.
• Upload content that you do not have rights to, or that infringes on any third-party rights.
• Harass, abuse, or harm other users.
• Attempt to reverse-engineer, hack, or disrupt the platform.
• Use the service for any commercial purpose without our written consent.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use at support@railspotter.app.

4. User Content

By submitting photos, notes, or other content to RailSpotter, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the platform. You retain ownership of your content and are responsible for ensuring you have the rights to submit it.

5. Points, Badges & Premium

Points and badges are virtual rewards with no monetary value and cannot be transferred or redeemed for cash. Premium subscriptions are billed according to the plan selected at signup. Refunds are handled on a case-by-case basis — contact support within 7 days of a charge for assistance.

6. AI Verification

Our AI-powered sighting verification is provided as a convenience tool. We do not guarantee the accuracy of AI-generated results. Points awarded are based on AI assessment and may be adjusted by administrators in cases of clear abuse.

7. Intellectual Property

All content, features, and functionality of RailSpotter (excluding user-submitted content) are owned by RailSpotter and protected by applicable copyright and intellectual property laws. You may not copy or reproduce any part of the platform without our written permission.

8. Third-Party Services

RailSpotter integrates with third-party services including Stripe (payments) and Google (advertising and AI). Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

RailSpotter is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that results obtained will be accurate or reliable.

10. Limitation of Liability

To the fullest extent permitted by law, RailSpotter shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

11. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time through your Profile settings.

12. Changes to Terms

We may update these Terms from time to time. Continued use of RailSpotter after changes constitutes acceptance of the new Terms. We will post the updated date at the top of this page.
